Hi Guys,
Last night I got pulled over by a rookie cop and ended up arrested for dwi, after "failing" the sobriety test. Funny part is that I was sober and only had 1 cup of wine during dinner, 2 hours prior to be pulled over. I asked the officer to do the breathalyzer test but he said it was not available and that would do it at the station. Once there they draw my blood and sent me to jail. Took me 18 hours and 500 bucks to get out of there.
Do you guys have any idea what route should I take here? Any good and budget friendly lawyer I can contact?

Good, and budget friendly, are not terms I would ever want to use together when talking about my lawyer. That said, I would find a good lawyer, and pay him what he asks. DWI is serious business and you don't want one on your record. Especially if you really weren't drunk.

I didn't drink not even close to the limit. He didn't let me do the breathalyzer. I asked for it cause I know I would come under the limit if not zero.

They didnt give you a copy of your blood toxicity report?

Not. They said it takes a couple days to get the results.

If you asked for a breathalyzer, and they were unable to give it, then you have nothing to be concerned about. A rookie lawyer could clear that charge with the dashcam evidence.

I'm about as FTP as they come, but the story (as told) does sound a little suspect. Good luck!

Why would I lie here if I'm looking for help. Otherwise I would say that I was drunk and how could I get a break, but that's not the case. I seriously had only one glass of wine.
Guess is bad luck and wrong place at the wrong time. Let's see what the lawyer will say.

I failed the sobriety test. The one about follow the pen with your eye, stand with only foot while counting down and walking in straight line.
He just told me I failed it don't know on what base.

Did you do field sobriety tests as well as Intox room tests again once you were downtown? It should all be on camera and you will receive copies of both before they are shown in court

lawyer up, get the best one money can buy do a retainer and just pay by the hour. If he gets you off after looking at the evidence and it only cost you 1k or so that is a good deal.

If it was in Dallas county then you just got put at the bottom of an extremely backed up pile of paperwork. I was 21 when I got mine and it wasn't settled in court until I was 23. Then begins the 3 years of 1k fines on the DL. In addition to the classes etc. etc.

The one thing that is going to be interesting is if you REFUSE breath and blood they yank your license for 180 days. If you give it to them then it's only 90 days.

Just curious did your insurance find out/raise your rates?

My employer wants to know the moment I get any alcohol related offense/ticket since they pull driving records every year. If my girl can't drive I call taxi even if im a block away nowadays.

Tough break and good luck but if all you had was that one glass of wine, there is no way it will come back with you over the limit. Not sure if they would drop the charges or come back with a wreckless driving charge to salvage something out of the arrest and more or less be a CYA move for them arresting you in the first place.

If you are charged, pony up the money for the lawyer and fight it tooth and nail. Look for one that specializes in DUI's. This can effect your employment and insurance rates for 5+ years.

The lawyers will be coming to you since that arrest is public record, just make sure you find a good one.
